01About these Terms

These Terms of Service (“Terms”) are an agreement between you and the Tamers Online project and the contributors who build and run it (“Tamers Online”, “we”, “us”). Tamers Online is an independent web3 project; it is not operated by a registered company. These Terms apply to the website, the game, the app and any related services (together, the “Services”).

By using the Services or connecting a wallet, you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

02Who can play

You must be at least 16 years old to use the Services. To buy, sell or trade cards you must be the age of majority where you live (18 in most countries) and able to enter into a binding contract.

You may not use the Services if you are subject to sanctions or live in a country where the Services or digital assets are prohibited. We may restrict access in some regions to comply with the law.

03Your account and wallet

You are responsible for your account, for keeping your access safe and for everything that happens under it. Tell us straight away at support@tamersonline.com if you think someone else has accessed it.

You sign in and own cards with a compatible Hedera wallet, provided by a third party and controlled only by you. We never have access to your private keys or recovery phrase, and we cannot recover them, reverse transactions or restore assets sent to the wrong address.

04Cards and NFTs

Cards will be issued as non-fungible tokens (“NFTs”) on the Hedera network. Each NFT represents one copy of a card. Owning the NFT means you own that token and can keep it, transfer it or use it in the game, as allowed by these Terms and by the network’s rules.

What you own, and what you license

Owning an NFT does not transfer the copyright or other intellectual property in the artwork, names, characters or game. Those remain with the Tamers Online project and its artists. While you own a card NFT, we give you a worldwide, non-exclusive, royalty-free licence to display and use its artwork for personal, non-commercial purposes, including showing it on social media and in community content. The licence moves to the next owner when you transfer the NFT.

You may not use the artwork to create and sell merchandise, register trade marks, or promote other products, unless we agree in writing.

Using cards in the game

Evolving a Companion, discarding a card or losing a match only happens inside the game. It does not burn, change or transfer your NFT.

05Assigned decks and free play

We may lend you an assigned deck so you can play friendly matches for free. Assigned cards are a licence to use, not property: they are not NFTs, cannot be sold or transferred and may be changed or withdrawn. Ranked matches may require a valid deck of cards that you own.

06Purchases and fees

No cards are on sale today. When sales open, prices for decks, packs and other products will be shown before you buy, in HBAR. Purchases are made directly on the Hedera network from your wallet, and you also pay the network fees that apply. If a product contains random cards, we will publish the odds before it goes on sale.

Because NFTs are delivered to your wallet immediately and blockchain transactions cannot be reversed, purchases are final once the transaction is confirmed, except where the law gives you a right to a refund. If you are a consumer in the EU or UK, you agree that delivery starts immediately and acknowledge that you lose your 14-day right of withdrawal once it does.

07Trading and royalties

You may sell or transfer your card NFTs on marketplaces that support them. Those marketplaces are run by third parties and have their own terms. Each card carries a royalty fee of 5% on secondary sales, set in the token on Hedera and paid automatically to the project treasury to fund development.

You are responsible for any taxes on your sales and for complying with the laws that apply to you.

08Game rules and balance

To keep the game fun and fair, we may change rules, card statistics, abilities, modes, rankings and rewards at any time, including cards you own. We publish these changes in our patch notes. Rule changes do not affect your ownership of the NFT itself.

The Services may be updated, interrupted for maintenance or, with reasonable notice, discontinued. If the game shuts down, your NFTs remain in your wallet.

09Fair play

You agree not to:

• cheat, use bots, scripts, exploits or modified clients;
• access accounts or wallets that are not yours, or share accounts to manipulate rankings;
• manipulate markets, wash-trade or deceive other players;
• harass, threaten or discriminate against anyone;
• interfere with the Services, reverse engineer them or overload our systems;
• use the Services for money laundering, fraud or any other unlawful purpose.

If you find a bug or vulnerability, please report it to security@tamersonline.com instead of using it.

10Community and your content

You keep the rights in content you post, such as names, messages, decks or fan art. You give us a non-exclusive, worldwide, royalty-free licence to host, show and share it in connection with the Services. You are responsible for your content and must have the right to post it. We may remove content that breaks these Terms.

11Third-party services

The Services rely on third parties such as the Hedera network, wallets, marketplaces and hosting providers. We do not control them and are not responsible for their availability, security, fees or terms.

12Risks you accept

Using blockchain technology carries risks, including:

• losing access to your wallet if you lose your keys;
• network delays, failures or changes in fees;
• changes in law or regulation that affect digital assets;
• the value of HBAR and of collectibles going down, or a market not existing at all;
• attacks on wallets, marketplaces or smart contracts outside our control.

13Not an investment

Please read. Tamers Online cards are digital collectibles made for playing and collecting. They are not securities, financial products or investments, and they give you no share in the project or its revenue. We make no promise about their value or price, and nothing we say is financial advice.

14Our intellectual property

The Services, the game, the artwork, the Tamers Online name and logo and all related content belong to the Tamers Online project and its artists and are protected by law. Apart from the rights given to you in these Terms, nothing gives you any right to use them.

15Disclaimers and liability

The Services are provided “as is” and “as available”. To the extent the law allows, we do not guarantee that they will be uninterrupted, error-free or secure.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, or for losses caused by third-party services or by the risks described in section 12. Our total liability to you is limited to the amounts you paid us in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

16Suspension and termination

You may stop using the Services at any time. We may suspend access for anyone who breaks these Terms or the law, with notice where possible. Suspension does not remove NFTs from your wallet, but you may lose access to in-game features, rankings and assigned decks.

17Changes to these Terms

We may update these Terms. If a change is significant, we will announce it in advance on this site. If you keep using the Services after the change takes effect, you accept the new Terms.

18Disputes

If something goes wrong, contact us first: most problems can be solved through support. These Terms are governed by the laws that apply to your use of the Services, including the consumer protection laws of the country where you live. Nothing in them takes away those rights, including the right to bring a claim where you live.
